Services > Brisbane Family Lawyers > Child Support
The payment of child support for children in separated families is either agreed upon by each parent, or assessed and monitored by the Child Support Agency.
Assessment by the Child Support Agency
The amount of child support payable is different in each case and is based on the application of a statutory formula which takes into account a number of factors such as:-
| the combined income of both parents; | |
| the ages of the children; and/td> | |
| the time each parent spends with the child. |
Binding and Limited Child Support Agreements
Child support agreement offer parents a flexible way of arranging child support. There are two types of agreements, Limited or Binding.
Limited agreements are formal agreements that are in writing and signed by both parents. The only requirements are that there must be a child support assessment in place and the agreed to amount payable under the agreement must be equal to or more than the child support assessed. Limited agreements can be set aside after three years or any time prior, by agreement between the parties.
Binding agreements require parents to seek independent legal advice prior to entering into or ending the agreement. The agreement can be made for any amount that both parents agree to, including amounts less than the formula assessment. Binding agreements can only be ended by the parties entering into a new agreement or a court order.
