For those people who do not have sufficient income to meet their reasonable needs, spousal maintenance payments from a former spouse or de facto partner may be critical and essential for daily living.
Spousal maintenance may be paid periodically (e.g. monthly) or it may be capitalised as a lump sum. It is different to child support which is payable solely for the financial support of children.
If and when usual financial support from a spouse is inappropriately cut off following a marriage or de facto breakdown, it is important to act quickly to rectify the situation without there being financial disasters and without undue financial suffering.
Maintenance may be payable if you are:
| separated or divorced from a legal spouse | |
| separated from a de facto partner after 1 March 2009 |
You can apply for maintenance after you separate but there are important time limits that apply. In special circumstances, it may be possible to get around these time limits
