Datalex plc (Datalex) in a Notice Provided to Shareholders has denied the allegations made by Flight Centre Limited (Flighties) in the Supreme Court of Queensland. The claim filed by Flighties on 4 November 2009 alleges misleading and deceptive conduct and breach of contract in relation to a software development contract. |
Datalex, in a notice (Notice) forwarded to Rostron Carlyle by their Solicitors Tucker&Cowan, previously sent to Shareholders of Datalex PLC, states that they intend to file a defence to the Claim and counterclaim for the alleged substantial damages arising from Flighties decision not to deploy their software across their travel agency business.
Additionally the Notice from Datalex states:
"We believe that the instittuion of these proceedings by Flight Centre is defensive in the extreme and their action is without any basis or merit and we will be fully defending them"
"We will continue to proceed with our action claiming payment by Flight Centre of monies due and owing to us for works that we have carried out for Flight Centre to date".
Datalex's claims as contained in the Notice are like Flight Centre's claims against Datalex, unproven.
We will watch with interest as the matter unfolds.
