Services > Commercial Property law > Resumption Law
| Rostron Carlyle's Resumption Law Practice has extensive experience assisting owners of both residential and commercial property which is being or has been resumed by a government agency to obtain the best compensation for the property owner. Our experience pursuant to both the Queensland Acquisition of Land Act 1967 and the Commonwealth Land Acquisition Act 1989. |
When you receive a Notice of Intention to Resume for either all or part of your property from either a City Council, Local Council or a Queensland or Federal government it is important that you obtain immediate advice on the consequences that the resumption will have on the property together with the appropriate level of compensation to which you are entitled given the circumstances. As such you should immediately engage a resumption lawyer and a property valuer.
When you receive a Notice of Intention to Resume you should know that:
| You are entitled to fair compensation from the government agency and in most cases you are entitled to your legal costs and the costs of a property valuer; | |
| The majority of claims settle without the need for court proceedings; | |
| Time limits apply to making a claim and as such it is important that you immediately contact a lawyer to discuss your claim; and | |
| Where necessary experts may need to be engaged to assist your claim the costs of which are usually paid by the government agency and which can be covered by our office. |
Given the number of major infrastructure projects that have been foreshadowed by the Queensland Government as a result of the population growth in Queensland (in particular the Brisbane City Council including the Airport Link, the Northern Link, the Northern Busway and the Cross River Rail Link) it is important that where your property is affected that you obtain expert advice as to the best way to handle your claim for compensation.
